Data Processing Addendum (DPA)

Definitions

In this Data Processing Addendum, the terms "Controller," "Processor," and "Subprocessor" shall be defined in accordance with applicable data protection laws, including the GDPR.

Zero-Retention Policy

Ark Hive operates under a strict zero-retention mandate for auditory data. While we process voice streams in real-time, no audio files or recordings are stored on Ark Hive's infrastructure. Processing is transient and entirely ephemeral.

Ark Hive Acts as Processor

For the purposes of our services, the Customer is the Controller and Ark Hive acts as the Processor of any personal data (primarily metadata and system logs) submitted to the platform.

Processing Instructions Defined

Ark Hive will process personal data solely in accordance with the documented instructions of the Customer, which are defined by the use of Ark Hive's platform and Terms of Service. This includes the automated purging of all audio data immediately following real-time analysis.

Security Measures

• Encryption in transit for all data
• Encryption at rest for account metadata
• In-Memory Processing: Zero persistent storage for audio streams
• Role-based access control
• Secure cloud infrastructure
• Limited employee access

Subprocessor Disclosure

Ark Hive engages authorized Subprocessors to assist in providing its services. A list of current Subprocessors can be provided upon request. We will notify you of any intended changes concerning the addition or replacement of Subprocessors.

Data Breach Notification Process

In the event of a personal data breach impacting your data, Ark Hive will notify you without undue delay after becoming aware of the breach.

Review Rights

Customers have the right to request information necessary to demonstrate adherence to this DPA, including the right to conduct a review or inspection under reasonable conditions.

Standard Contractual Clauses Reference

For cross-border data transfers outside the EEA, Ark Hive relies on the European Commission's Standard Contractual Clauses as a legal mechanism where applicable.
